How does pre-settlement funding assist plaintiffs?

Pre-settlement funding provides financial security to plaintiffs involved in a personal injury lawsuit. Typically, plaintiffs will have an urge to settle early, pre-settlement funding allows plaintiffs to pay for day-to-day expenses, medical bills, or other expenses while their attorney takes the time to fight for what the case is worth.

How does pre-settlement funding work?

An underwriter reviews your case for potential funding. If approved an agreement is sent to the plaintiff and the attorney for signature, once both agreements are signed funds can typically be sent out the same day.

How can pre-settlement funding be used?

Pre-settlement funding can be used for day-to-day expenses, car expenses, medical bills or rent. The funding is made to hold you over until your settlement.

Who is eligible for litigation financing?

A plaintiff who is involved in a personal injury lawsuit, or other lawsuits (see the case types we fund?) with a strong case against the defendant. The plaintiff must be represented by an attorney on a contingency basis.

What types of cases are eligible for the litigation funding?

Cases that are eligible for the litigation funding include but are not limited to, Boy Scouts of America cases, false arrest, premise liability, motor vehicle accidents, civil rights, third party workers compensation, wrongful termination, pedestrian injury, wrongful death, and medical malpractice.

When do I have to pay the money back?

The money is to be paid back after the case is won and your attorney receives the settlement money if you lose the case, you are not required to pay back the money.

What stage of litigation do the cases need to be in order to be considered?

The case will need to be filed and have enough supporting documents for our underwriter to review. 

Are there restrictions on how the funds can be used?

There are no restrictions on how the funds can be used, pre-settlement and post-settlement funding are often used to pay medical bills, day to day expenses, car bills, rent and groceries.

How long does it take to get cash?

Once your application is approved and the purchase agreement accepted, you’ll receive your settlement advance in less than 24 hours.

How much am I eligible for?

The plaintiff can request whatever amount they need, although ultimately the decision will be based on the strength of the case and current stage of litigation.
